Expert Testimony, Consultation & Advocacy
In the wake of legislative changes throughout Canada, arbitrators, tribunals and the courts are increasingly being asked to hear cases of alleged workplace violence, generalized harassment (bullying) and other abusive behaviours. In recent years there have been significant judgements in favour of victims of violence and harassment, sending a clear signal to employers that workplace violence, in whatever form, cannot be ignored.
With a solid reputation in applied research, advocacy, and policy development, the Canadian Initiative provides expert testimony on behalf of organizations who are accused of failing in their obligation to protect employees from workplace violence and other forms of abuse. In support of your defence, the Canadian Initiative partners with your legal and HR teams, by providing background research and expert commentary regarding best practices, in relation to organizational risk assessments, policies and procedures, hazard investigations and/or threat response, to name a few of the areas that we are frequently asked to comment on.
As well, the Canadian Initiative routinely consults with individual victims of workplace violence and abuse by providing the same high quality research and consultation to their legal counsel and elected representatives as the case requires. In addition, we are often called upon to advocate for victims, as a way of avoiding costly legal action.
